Terms of service
These Terms of Service govern your access to and use of the Euro and East Coast Supply Group Limited online store. By accessing or purchasing from our store, you agree to be bound by these terms. If you do not agree, do not use our store.
1. Eligibility
You must be at least 18 years of age to place orders on our store. By using our store, you represent that you are 18 years of age or older and have the legal capacity to enter into a binding agreement under Kenyan law. If you are placing an order on behalf of a business entity, you represent that you are authorised to bind that entity to these terms.
2. Store Account
You may use our store as a guest or by creating an account. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorised access to your account. We reserve the right to suspend or terminate accounts that breach these terms or that we reasonably suspect are being used fraudulently.
3. Products and Availability
We make every effort to accurately display product descriptions, images, sizes, and specifications. Minor variations in colour may occur due to screen settings and are not considered a product defect. Products are subject to availability. We reserve the right to limit quantities, discontinue products, or withdraw items from sale at any time without notice. If an item is out of stock after you have placed an order, we will notify you and offer a full refund or a substitute product.
4. Pricing
All prices are displayed in Kenyan Shillings (KES) inclusive of Value Added Tax (VAT) at the applicable rate unless otherwise stated. We reserve the right to change prices at any time without prior notice. The price applicable to your order is the price displayed at the time you complete checkout. If a pricing error is identified after an order is placed, we will notify you and give you the option to confirm the order at the correct price or cancel for a full refund.
5. Orders and Contract Formation
Placing an order on our store constitutes an offer to purchase. A contract is formed when we send you an order confirmation by email. We reserve the right to refuse or cancel any order for reasons including but not limited to: suspected fraud, pricing errors, product unavailability, or incomplete payment. If we cancel an order, we will issue a full refund of any amount paid.
6. Payment
We accept payment by the methods displayed at checkout, which may include credit and debit cards, M-Pesa, and other electronic payment platforms. All transactions are processed securely. Payment must be completed in full before an order is dispatched. We do not store your full card details on our servers. All payment processing is handled by our third-party payment service providers in compliance with applicable security standards.
7. Promotions and Discount Codes
We may offer promotional codes and discounts from time to time. Promotions are subject to their own terms and may have validity periods, minimum order values, or product restrictions. Only one discount code may be applied per order unless stated otherwise. We reserve the right to withdraw or amend promotions at any time. Promotions cannot be applied retroactively to orders already placed.
8. Intellectual Property
All content on our store including text, images, graphics, logos, product descriptions, and software is the property of Euro and East Coast Supply Group Limited or our licensors and is protected under Kenyan and international intellectual property laws. You may not copy, reproduce, distribute, or use our content for commercial purposes without our prior written permission. You may share links to our products for personal, non-commercial purposes.
9. User Conduct
You agree not to:
• Use our store for any unlawful purpose or in violation of any applicable Kenyan or international law
• Submit false, misleading, or fraudulent information
• Interfere with or disrupt the security, integrity, or performance of our store
• Attempt to gain unauthorised access to our systems or any other user's account
• Post or transmit harmful, offensive, or spam content through any communication feature on our store
• Use automated tools to scrape, crawl, or extract data from our store without our written consent

We do not endorse, control, or take responsibility for the content, privacy practices, or terms of any third-party website. Your use of third-party websites is at your own risk and governed by their own terms and policies.
11. Limitation of Liability
To the maximum extent permitted by Kenyan law, Euro and East Coast Supply Group Limited is not liable for any indirect, incidental, consequential, or punitive damages arising from your use of our store or the products purchased through it. Our total liability to you in connection with any claim arising from these terms or your use of our store shall not exceed the amount you paid for the specific order giving rise to the claim.
Nothing in these terms limits or excludes liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under Kenyan law.
12. Indemnity
You agree to indemnify and hold harmless Euro and East Coast Supply Group Limited, its directors, employees, and agents from any claims, damages, losses, or expenses including reasonable legal fees arising from your breach of these terms, your use of our store, or your infringement of any third-party rights.
13. Governing Law and Disputes
These terms are governed by and construed in accordance with the laws of Kenya. Any dispute arising from these terms or your use of our store shall first be referred to us for resolution. If unresolved within 30 days, the dispute shall be referred to mediation or, if mediation fails, to the courts of Kenya which shall have exclusive jurisdiction.
14. Amendments
We reserve the right to update or modify these Terms of Service at any time. Changes will be posted on our store with a revised effective date. Continued use of our store after changes are posted constitutes your acceptance of the revised terms. We recommend reviewing these terms periodically.
15. Severability
If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a competent court, that provision will be modified to the minimum extent necessary to make it enforceable. The remaining provisions will continue in full force and effect.
16. Entire Agreement
These Terms of Service, together with our Privacy Policy, Refund Policy, and Shipping Policy, constitute the entire agreement between you and us regarding your use of our store and supersede any prior agreements or understandings.
